Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Influencers Canada services, including our public marketing website at influencerscanada.com (the “Site”) and our web application at app.influencerscanada.com (the “App”, and together with the Site, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and accounts
You must be able to enter a binding contract in your jurisdiction to use the App and paid features. You are responsible for the accuracy of information you provide when creating an account and for keeping your login credentials secure. Notify us promptly if you become aware of unauthorized access to your account.
The Services
Influencers Canada provides tools to discover creator profiles, publish or manage listings, and communicate between users where the product supports it, subject to your subscription and settings. Features may change over time; we may add, modify, or remove functionality with reasonable notice where appropriate.
The Services are a discovery and connection platform. We do not guarantee campaign outcomes, sponsorships, or business results. Listings and messages reflect user-provided information; you are responsible for your own diligence before entering collaborations or commercial arrangements.
Subscriptions and billing
Paid plans are billed in Canadian dollars (CAD) through our payment processor (Stripe). By subscribing, you authorize charges according to the plan you select. You can manage payment methods, invoices, and cancellation through the billing flows in the App (including the Stripe Customer Portal where applicable). Fees are non-refundable except where required by law or as expressly stated at checkout.
If payment fails or your subscription ends, access to paid features may be suspended or limited until payment is restored or you resubscribe.
Acceptable use
You agree not to:
- Violate applicable law or third-party rights
- Harass, threaten, defraud, or impersonate others
- Upload malware, attempt to breach security, or disrupt the Services
- Scrape, crawl, or harvest the Services in violation of these Terms or technical limits we apply
- Use the Services to send spam or unsolicited bulk messages outside legitimate in-product messaging
- Misrepresent audience size, metrics, or affiliation with brands or creators
We may investigate misuse and may suspend or terminate access for conduct we reasonably believe violates these Terms or harms users or the Services.
Creator listings and user content
Creators are responsible for the content of their profiles and any materials they upload or display (“User Content”). You retain ownership of your User Content; you grant Influencers Canada a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and distribute User Content as needed to operate, promote, and improve the Services (including showing listings in the directory and on the Site where applicable).
You represent that you have the rights needed to grant that licence and that your User Content does not infringe third-party rights. We may remove or restrict content that violates these Terms or that we are required to remove by law.
Messaging and conduct between users
Interactions between creators and brands or other users are between those parties. Influencers Canada is not a party to your deals, contracts, or disputes. Use reasonable care when sharing contact details or entering collaborations.
Intellectual property
The Services, including branding, design, and software (excluding your User Content), are owned by Influencers Canada or its licensors and are protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, or reverse engineer the Services.
Third-party services
The Services may integrate with or link to third parties (for example payment processing, hosting, or social platforms). Those services are governed by their own terms and policies. We are not responsible for third-party services we do not control.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFLUENCERS CANADA AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO INFLUENCERS CANADA FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
Indemnity
You will defend and indemnify Influencers Canada and its affiliates against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, or your violation of these Terms, to the extent permitted by law.
Suspension and termination
We may suspend or terminate your access to the Services if you materially breach these Terms, if we must comply with law, or if we discontinue the Services (with notice where practicable). You may stop using the Services at any time. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.
Governing law
These Terms are governed by the laws of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario, subject to mandatory consumer protections in your jurisdiction where they cannot be waived.
Changes
We may update these Terms from time to time. We will revise the “Last updated” date above. For material changes, we may provide additional notice (for example by email or in-product). Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
